ORDER NO.  01-10-01

 

PROHIBITION OF OPEN FIRES ON

NATIONAL FOREST LAND IN NORTH CAROLINA

 

 

Pursuant to 36 CFR 261.50 (a) and (b), and for the protection of the public and natural resources, the following acts are prohibited on the Pisgah, Nantahala, Uwharrie and Croatan National Forests in North Carolina.  This Closure is effective from October 29, 2001 through February 1, 2002.

                        

1.      Building, maintaining, attending or using a fire, campfire, or warming fire other than within a developed recreation area and only in developed fire pits, grills or fire rings.          36 CFR 261.52 (a)

 

 

2. Violating any state law concerning burning or fires, which are implemented for the purpose of preventing or restricting the spread of fires.  36 CFR 261.52(k)

 

Note: The use of cooking stoves is not restricted by this order.  This order is in effect until cancelled by the Forest Supervisor.

 

Pursuant to 36 CFR, Sec. 261.50 (e) the following persons are exempt from this Order:

 

(1) Persons with a permit specifically authorizing the prohibited act or omission.

 

(2) Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty.

 

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

Violation of the prohibition set forth above is punishable by a fine of not more than $5,000 for an individual and 10,000 for an organization or imprisonment of not more than six (6) months, or both.  16 USC 551 and 18 USC 3559 and 3571.
